Who We Are
BYWHA ("we", "our", or "us") provides a platform and, optionally, setup services for WhatsApp, Messenger, Instagram and Telegram business messaging. This Privacy Policy explains what data we collect, how we use it, and the rights you have over it.
BYWHA AGENCY is the trading name of a Sole Proprietorship (Entreprise Individuelle) registered with the Trade and Personal Property Credit Register (RCCM) of Cotonou under number RB/ABC/26 A 144319. For full details, see our Legal Notice page.
Two Roles We Play With Your Data
This matters because it changes what applies to which data:
- As a platform provider (data controller): we collect and control data about you and your business account — your name, email, company details, billing information, and how you use the dashboard.
- As a service provider to your business (data processor): once you connect your own WhatsApp, Messenger, Instagram or Telegram account, the messages and contacts that flow through the platform belong to you and your customers — we process that data on your behalf, following your instructions, not our own.
Information We Collect
a. Account Information
Name, email, phone number, business name, and login credentials (encrypted) when you sign up.
b. Messaging & Contact Data
Conversations, contact lists, message content, media files (images, documents, audio), and call logs that pass through channels you connect to the platform. This data is controlled by you, not by us.
c. Technical Data
- IP address, browser type, device information
- Usage logs, collected automatically when you use the platform or visit our website
d. Cookies
Small files used to keep you signed in and understand how the site is used. You can control cookies through your browser settings.
e. Payment Information
If you subscribe to a paid plan, billing details are processed by our payment provider; we do not store full card numbers ourselves.
How We Use This Information
- To provide and maintain the platform and its features (inbox, automations, broadcasting, call handling)
- To process payments and manage your subscription
- To provide setup support if you request our optional configuration service
- To communicate with you about your account, updates, or support requests
- To improve the platform and monitor for technical issues or abuse
- To meet legal obligations, including compliance with Meta's Business API policies
Who We Share Data With
- Meta — WhatsApp, Messenger, and Instagram messaging is delivered through Meta's official APIs, subject to Meta's own data policies
- Telegram — messages sent via Telegram are subject to Telegram's own terms
- Hosting and infrastructure providers — who store and process data on our behalf, under confidentiality obligations
- Google services — where you connect integrations such as Google Sheets or similar tools
- Payment processors — to handle billing securely
We do not sell your data or your customers' data to third parties.
International Data Transfers
Our infrastructure is hosted with a European hosting provider, with data centers located within the European Union. Depending on where you and your customers are located, data may still be processed or stored in a different country than where you operate; where applicable, we take reasonable steps to ensure data is protected to a standard consistent with regulations such as the GDPR.
Data Retention
We keep account and messaging data for as long as your account is active, and for a reasonable period afterward to meet legal, accounting, or dispute-resolution needs. You can request deletion of your data at any time (see "Your Rights" below).
Security
We use industry-standard measures — encryption in transit, access controls, and secure hosting — to protect your data.
Despite best efforts, no system is 100% secure. We encourage you to use a strong password and enable any available account protections.
Your Rights
If you are located in the European Economic Area, UK, or another jurisdiction with similar protections, you have the right to:
- Access the personal data we hold about you
- Correct inaccurate data
- Request deletion of your data
- Object to or restrict certain processing
- Request a copy of your data in a portable format
- Withdraw consent at any time, where processing is based on consent
To exercise any of these rights, contact us using the details below.
If you are a customer of one of our business clients (i.e., you messaged a business using BYWHA), please contact that business directly, as they control your data — we process it only on their instructions.
Children's Privacy
BYWHA is not intended for individuals under the age of 16.
We do not knowingly collect personal data from children.
Changes to This Policy
We may update this policy from time to time. Material changes will be communicated via the platform or by email.
Continued use of BYWHA after changes take effect means you accept the updated policy.
